Title : Credit News: Another Website Selling People's Financial Information This Time In The UK
Credit News

Websites Selling UK Bank Account and PIN Information

There has been another case of sites found to be selling people's financial and personal information.  This time it's in the UK where tens of thousands of customers information are up for sale on these websites.  The The TimesOnline was able to download 32 different people's data without paying a cent on getting this information. These accounts included data from a high court deputy judge and a managing director. As is noted in the original story by the TimesOnline, these accounts were offered as teasers to getting people to purchase more accounts from this website.

Apparently there were 2 lost CD's with over 25 million Briton accounts which were lost and still have not been recovered. In the black market the value of this information is said to be worth approximately $100 Million dollars. All of this information is very alarming despite the fact that these are isolated to Briton's and isn't affecting the US customers.

As we have been saying for quite some time here at Credit Repair Combat, there needs to be processes and procedures in place which mimic government security measures when companies handle people's financial and personal information. One suggestion is dividing peoples information so that not all data is included in one location or file. This makes it much more difficult for information about consumers can be used. You can read the full story by the TimesOnline at the link above.

Housing Market is Crippling Consumer Loans and The Economy

As most of you probably have already heard, the credit markets are suffering in a big way due to the housing market and consumers defaulting on loans.  As Credit Repair Combat has always pointed out, a good credit report doesn't necessarily indicate true credit worthiness and although most of the issues with the credit market right now have to do with sub-prime loans, it's still an indication that credit reports don't always indicate a true picture of someone who may or may not be credit worthy.

The current credit market woes are so serious this quarter that it's very likely going to affect the first quarter of 2008 and as you know if we go through another quarter such as this one, the country will officially be considered in a recession (it takes two consecutive bad quarters to be officially designated as being in a recession).

According to the National Association for Business Economics the gross national product is down 1.5 percent from 3.9 for July through September of this year.  This is a huge decline and it's all attributed to the credit and housing market concerns.  It was forecast earlier this year that the economy would grow by about 2.1 percent, an all time low since 2002, but with it now being forecast at a meager 1.5 percent for this quarter, the impact has been huge.

Visa Pays 2.1 Billion in Damages To Settle Antitrust Lawsuit

In a 2004 Antitrust Lawsuit, Visa has agreed to pay American Express 2.1 in damages to settle the case which is said to be the largest amount ever paid for an antitrust lawsuit case.  Three years prior the Supreme Court had ruled that Visa and Mastercard violated antitrust rules by preventing member banks from from offering rival credit cards, specifically American Express and Discover.

Both American Express and Discover soon filed suit and with Visa now settling with American Express will most likely also settle with Discover for the same offenses.  Both Discover and American Express have indicated that they lost Billions is revenue because of this barring of their cards within their member banks.

It's very likely that we will see AMEX turning their focus on Mastercard now that Visa has settled it's suit with them.

In light of these recent developments some of the other big credit card companies such as Bank of America and Citigroup have both signed deals to offer American Express Branded credit cards in an effort to ensure that they don't fall prey to breaking any of the antitrust laws that Visa is now paying for.

Title : Credit Bureaus: Get Your FREE Credit Report Every Year - It's The Law!
Credit Bureaus
Credit Bureaus

That's Right, You Can Get A Copy Of Your Credit Report FREE Every Year From Each Of The Credit Bureaus.

It amazes me how companies are capitalizing on the amended FCRA which was enacted in 2003 via FACTA by proclaiming that they will give you a copy of your credit reports from the Big 3 Credit Bureaus for FREE!  You've probably seen the commercials recently of these companies saying they will give you a copy of your credit reports and credit score for FREE, but in reality, you can get your credit reports for free without any of these TV commercial companies.  Why? Because it is now federal law that the credit bureaus must provide you with a FREE credit report every single year.  What these TV commercials also don't tell you is that you have to sign up for a service which will cost you a monthly fee after they've given you your free credit reports.

So how is it that you can get your credit reports free yourself?  Well I'm glad you asked.

On December 1st of 2004, the three nationwide consumer reporting companies, Equifax, Experian and TransUnion, began processing requests by consumers for their free annual credit reports, which you can also do now at www.annualcreditreport.com The Fair and Accurate Credit Transactions Act of 2003 (FACTA) amended the Fair Credit Reporting Act (FCRA) requiring the credit Bureaus to provide consumers with free credit reports every 12 months.  Initially only the 13 Western States were allowed this priveledge but is now good in all States.

Title : Credit Bureaus: Credit Bureaus Looking To Kill The Pig In Piggybacking
Credit Bureaus
Credit Bureaus

The Credit Bureaus are working to kill the Piggybacking method of credit repair by modifying the FICO Scoring model.

People shouldn't really be surprised by this move by the credit bureaus to eliminate this method of credit restoration since it has become almost a fad in helping people build good credit within the industry.  If you are unfamiliar with what piggybacking is within the credit world, let me explain.

Let's say you are someone who has little to no credit and you wanted a quick way to build credit so that you could begin getting loans or credit cards with high credit limits.  The quickest way to build this kind of credit history is to do what is called piggybacking where you basically rent someone else's high credit score.  There are credit repair companies who contract with individuals who have high credit scores, typically with FICA scores in the 750 to 800+ range, who are willing to rent out there high scoring credit score by allowing an individual to be placed on their high limit credit card as an authorized user of the card.

This placement on someone's credit card as an authorized user is done for a fee which the credit repair company then pays the credit renter a fee for allowing the authorized user to be placed on their card.  So for example the credit repair company would find an individual with a high credit score, pay them $200 to allow them to place an authorized user on one of their credit cards for a month.  The credit repair company would then charge an individual who needs credit a fee of $1500 to $2000 dollars for this authorized placement and would almost immediately gain a huge boost in their credit score because the authorized user would now be shown as having this new credit account on their credit report.

No personal information is ever exchanged between the two parties and the credit repair company handles all the personal data between the parties so it is completely anonymous in nature.  The authorized user is never given information about the account itself so there is no risk of the authorized user charging up items to this credit card.  This entire process is what is referred to as Piggybacking.

Security Breach Exposes 40 Million Credit Cards

MasterCard yesterday warned of a security breach at Tuscon, AZ-based CardSystems that dwarfs recent reports of financial data loss. The company is reporting that information on up to 40 million credit cards may have been exposed at the third-party credit card payment processor, 13.9 million of those belonging to MasterCard customers.

CardSystems processes over "$15 billion in Visa, MasterCard, American Express, Discover, on-line debit and EBT transactions annually", according to the company's website.

The breach was discovered, in part, by fraud protection mechanisms employed by MasterCard, according to a statement. The companies then traced the problem to vulnerabilities within CardSystems' network, which allowed an unauthorized person to gain access to card-holder data. In a differing account, CardSystems does not make mention of MasterCard's involvement, but says that the breach occurred on May 22, 2005. On the following day, the company contacted the FBI.

Title : Credit Law: FTC Issues Final Rule on Free Annual Credit Reports (FACTA)
Credit Law

Final Rule on Free Annual Credit Reports (FACTA)

The Federal Trade Commission has issued its final rule regarding free annual credit reports under the Fair and Accurate Credit Transactions Act (FACTA) and the Fair Credit Reporting Act (FCRA). FACTA, which was enacted on December 4, 2003, amends the FCRA and requires, among other things, that the three nationwide consumer reporting agencies (CRAs) – Equifax, Experian, and Trans Union – provide to consumers, upon request, a free copy of their credit report once every 12 months.

The Commission published a notice of proposed rulemaking in the Federal Register on March 19, 2004, and accepted comments until April 16, 2004. The Commission received more than 2,300 comments from consumers, consumer advocates, elected officials, industry members, and trade associations.

The final rule contains many of the provisions of the proposed rule, with some modifications. Under the final rule, the nationwide CRAs must establish a “centralized source” for accepting consumer requests for free credit reports (called annual file disclosures in the final rule). This centralized source must include a dedicated Internet Web site, a toll-free telephone number, and a postal address.

The final rule also provides for a gradual, structured roll-out of the centralized source. The centralized source will become available in cumulative stages, over a period of nine months, rolling-out from west to east beginning December 1, 2004. The entire transition will be complete by September 1, 2005. Consumers will become eligible on the following schedule: Western states (Alaska, Arizona, California, Colorado, Hawaii, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming) will become eligible on December 1, 2004; Midwestern states (Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Nebraska, North Dakota, Ohio, South Dakota, and Wisconsin) will become eligible on March 1, 2005; Southern states (Alabama, Arkansas, Florida, Georgia, Kentucky, Louisiana, Mississippi, Oklahoma, South Carolina, Tennessee, and Texas ) will become eligible on June 1, 2005; and Eastern states (Connecticut, Delaware, District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, Vermont, Virginia, and West Virginia), Puerto Rico, and all U.S. territories will become eligible on September 1, 2005.

What does this mean in laymen's terms? It means that starting on December 1st 2004, all western States will be eligible for their free credit once a year from all three major credit bureaus. Some of them are already complying with the law in this reagard and if you send the proper proof of who you are, they will send you your free reports.

Send the following information:

- Copy of current utility bill
- Copy of your social security card
- Indicate your Name, Address, Date of Birth, and the request for your credit report.

That's all there is to it.

Bogus July 1 Email Exposed: The Real Deal on Your Credit File Privacy

An anonymous email containing false and misleading information about the use of your personal information is showing up in email in-boxes across the country, leaving many consumers concerned and confused.

Here's what the bogus email says:

"Just wanted to let everyone know who hasn't already heard, the four major credit bureaus in the U.S. will be allowed, starting July 1, to release your credit info, mailing addresses, phone numbers... to anyone who requests it. If you would like to "opt out" of this release of info., you can call 1-888-567-8688. It only takes a couple of minutes to do." Here's the real deal from the Federal Trade Commission (FTC), the agency that enforces the Fair Credit Reporting Act (FCRA).

  • The July 1 deadline relates to the Gramm-Leach-Bliley Act (GLB), which set July 1, 2001 as the deadline for financial institutions to give you notice of their privacy policies and a way for you to opt-out of some of their information-sharing practices. You may recall getting mailings or statement inserts recently from your financial institutions, creditors, insurance companies and brokerage firms about this. The July 1 date is not a deadline for consumers to do anything. In fact, consumers can contact their financial institutions anytime to opt-out under GLB.
